 Acquiring property: Natural and legal persons from other countries may acquire title to business facilities, flats and residential buildings as well as of agricultural land (with the exception of “prohibited zones”). Civic building property is owned by the state and may not be purchased. The property can, however, be leased or the rights of use may be acquired. Natural persons from foreign countries having a permanent residence may also acquire title to a flat or residential building (business activity is not a precondition).

 

Pursuant to Art 82a GEV, a legal person may only acquire title to immovable property, however, if said person, firstly, conducts activities as an entrepreneur in Serbia and the immovable property is necessary for conducting that activity, and if, secondly, a reciprocity agreement on the acquisition of title to immovable property exits between Serbia and the country where said legal person has its seat. The existence of reciprocity is confirmed on the basis of a declaration issued by the ministry of justice. In the form of official decisions, the ministry of foreign trade relations issues opinions concerning the necessity of acquiring property for the purpose of conducting business activities in Serbia.

 

Land registry: Generally speaking, the land registry system corresponds to the Austrian system of a separate page in the land registry for each piece of property. Both land registries and property cadasters currently exist in Serbia, whereas a system change involving the transfer of all registry entries to the property cadaster is taking place at the moment.

 

For the first instance when the right of disposal is transferred, a value-added tax of 8 % is levied, and for each following transfer the tax rate is 2.5 %.
